LANCASTER City Council could face a backlash by local motorists following the recent Tonight with Trevor McDonald' TV programme which high-lighted anomalies regarding road traffic signage under the Road Traffic Act 1991.
It pointed out that under certain conditions a motorist can legally challenge a fixed penalty fine imposed by the local council if the road traffic signage does not comply with the law the council uses to enforce restrictions around the city.
In other words, where the signage is unclear or incorrect, a motorist can ignore it and challenge any fixed penalty notice on a technicality' and have it revoked.
I have been out with my camera and photographed five examples of incorrect road signage relating to double yellow lines within 500 yards of each other.
While not an advocate of irresponsible parking, according to the programme a motorist could ignore the double yellow lines and park.
My point is this: if Lancaster City Council is going to enforce parking restrictions then it must make sure its signage complies with the law it uses to enforce the restrictions.
