MEMBERS of Windermere Town Council have been told that they cannot sell some land at the town's war memorial.
A neighbour had approached the council to ask if it would be possible to acquire a piece of land to use for car parking. The council sought advice from the National Association of Local Councils, and its legal experts told members that according to the terms of the memorial trust deed, they could not sell or lease the land. Clerk Brian Whittaker said he would write to the neighbour to advise him of the decision. In the meantime, he would also make an approach about registering the land with the Charity Commission. The Charity Commission can authorise the disposal of charity land that is not required for the purposes of the charity. If the council went ahead with registration, and the commission authorised the sale of some land, the proceeds could then be used to maintain the war memorial.
