A PENSIONER is bringing a judicial review against Cumbria County Council over its decision to charge vulnerable people across the county for day centre care without consultation.
Nellie Helen Berry, of Grange-over-Sands, is taking the case forward after a legal charity, the Public Law Project, agreed to pay the costs involved.
The charity believes CCC's decision to charge £10 per day for day care from October, without formally consulting users first, was illegal.
The £10 charge is being levied because CCC has decided to no longer subsidise the service. It would be a means tested charge, which not everyone would pay.
The fee would be in addition to the £3.40 per day the 1,500 users already pay towards the cost of a meal and transport to and from the centres.
